CBAM and EUDR regulations
- applicability, reporting methods and responsibilities -

CBAM - the EU Carbon Footprint Border Adjustment Mechanism (CBAM) to set a fair price for the carbon emitted during the production of carbon-intensive goods imported into the EU and to encourage cleaner industrial production . CBAM targets imports of products considered polluting – cement, iron and steel, aluminium, fertilisers, polymer-based products, hydrogen or ammonia. This mechanism will work through the purchase of certificates by importers. Importers of goods will have to, either individually or through a representative, register with the national authorities where they can also buy CBAM certificates. Entry into force: On October 1, 2023, CBAM entered into force in its transition phase, with the first reporting periods for importers ending on January 31, 2024 and April 30, 2024 respectively.

EUDR - The EU's Deforestation-Free Regulation, which entered into force on 29 June 2023, aims to reduce the production and consumption of goods and derived products related to deforestation and forest degradation entering or leaving the EU market. EUDR covers a wide range of wood products, including timber, wood-based materials, paper and furniture, as well as rubber. The EUDR also applies to palm oil, soybeans, coffee, cocoa and beef. Companies importing or exporting listed products will need to carry out due diligence to confirm that they do not come from land that has been cleared or degraded after 31 December 2020. Companies will also need to check that these products comply with relevant legislation in the country of production, including respecting human rights and the rights of affected indigenous peoples.
